Privacy, Legal and Compliance Policy

This policy explains how Creativ Recruits collects, uses, stores, and protects personal information in line with the Protection of Personal Information Act (POPIA) and applicable international data protection standards. We collect only the information necessary for recruitment and placement services, including:

  • Employment history, qualifications, and career preferences
  • Supporting documents such as CVs, references, and IDs
  • Special Personal Information: Where required for Employment Equity or vetting (e.g. race or criminal record), we process this only with your explicit consent or where legally mandated

Data Protection and Retention

  • Security: Data is stored using encryption, password protection, and restricted access
  • Retention: Unsuccessful candidate data is deleted or anonymised after 24 months unless consent is renewed
  • Breach Reporting: In the event of a security compromise, we will notify the Information Regulator via the mandatory eServices Portal and notify affected individuals as soon as reasonably possible

Cross-Border Data Transfers

Creativ Recruits utilises cloud-based storage and software services (such as Google Drive, Microsoft 365, or specialised recruitment platforms) which may host data on servers located outside of South Africa (e.g. in the USA or European Union).

We ensure that these service providers are subject to laws or binding agreements that provide an adequate level of protection substantially similar to POPIA, as required by Section 72 of the Act.

Direct Marketing and Telemarketing

Creativ Recruits follows a strict Opt-In policy for all electronic communication (Email, SMS, WhatsApp) and telemarketing. We do not use opt-out models.

Creativ Recruits provides professional recruitment and permanent placement services. All candidate evaluations and shortlisting decisions are conducted with human review.

Liability and Responsibility

Creativ Recruits acts as an intermediary between candidates and clients. While reasonable care is taken to verify information provided by candidates, final verification of qualifications, references, employment history, and suitability remains the responsibility of the hiring organisation. Creativ Recruits cannot guarantee employment outcomes or candidate performance.

Governing Law

This policy and the use of Creativ Recruits' website and services are governed by the laws of the Republic of South Africa, including the Labour Relations Act, the Employment Equity Act, the Protection of Personal Information Act, and the Promotion of Access to Information Act.
